Terms & Conditions

These terms and conditions apply to all bookings made with Always Winter Tours LLC. By confirming your booking, you agree to these terms. Please read and understand them carefully.
Payment Terms
All payments must be made to the Always Winter Tours LLC business account. Please refer to the payment details on your booking confirmation invoice. Unless stated otherwise, your booking will be confirmed only after full payment is received. To secure your booking and avoid any delays, we strongly recommend completing the payment promptly.
Credit Card Surcharge: Payments made by credit card are subject to a 3% processing surcharge, which will be added to the total amount due. This surcharge does not apply to payments made by bank transfer or other accepted payment methods, and will be clearly itemized on your booking confirmation invoice.
Insurance Requirements
Always Winter Tours LLC does not include any form of insurance for the client/customer within the booking. You are responsible for obtaining suitable insurance coverage. This must include coverage for snow sports activities, medical expenses for injuries, and personal liability for any harm caused to others.
If you have booked a guided tour or backcountry product, you must ensure that your insurance specifically covers accidents or injuries that may occur while engaging in snow sports activities, including in "off-piste" areas, out-of-resort locations, and non-lift-assisted terrain. Please note that this is not an exhaustive description of required coverage; it is the customer's responsibility to ensure that their insurance coverage adequately matches the specific requirements of the product they have booked.
Always Winter Tours LLC reserves the right to request proof of valid insurance coverage prior to the commencement of any activity, and may decline participation where satisfactory proof is not provided.
Complementary Services
Transportation may be provided as a complimentary service by Always Winter Tours LLC, depending on the selected product or service. Always Winter Tours LLC does not assume any liability for claims related to transportation services provided by associated members.
Customer-Initiated Changes and Cancellations
If you choose to cancel your participation in a scheduled snow sport activity, please notify us as soon as possible.
- Cancellation under 30 days' notice: No refund will be provided.
- Cancellation within 31 to 90 days' notice: A 50% refund will be provided.
- Cancellation greater than 90 days' notice: A full refund will be provided, minus a 15% administration fee.
- Reduction of Booking: Reducing the booking is considered a cancellation and will be subject to the same cancellation policy.
If you choose to modify your booking, please inform Always Winter Tours LLC as soon as possible. A USD 150 administration fee may apply to any booking modifications.
Attendance Policies
- If a client misses a scheduled booking or arrives more than 30 minutes late without prior notice, and neither the client nor the booking agent informs the instructor/guide about the delay, the situation will be treated as a cancellation with less than 24 hours’ notice. In such cases, no compensation or refunds will be provided.
- However, the instructor/guide will make every effort to contact the client to continue with the booking. Our instructors/guides are willing to wait as long as necessary, provided they are kept informed, and weather conditions and external circumstances permit.
- Please note, a booking is officially considered to begin at the agreed-upon time set before the booking. It does not start when the client arrives to meet the instructor/guide.
Cancellation by Always Winter Tours LLC
No compensation will be provided for cancellations due to factors beyond our control, including but not limited to severe weather, avalanche risks, lift closures, equipment failures, or other unforeseen events that impact snow sports activities ("Force Majeure Events").
In such cases, we will attempt to reschedule the activity or offer alternative options, such as other snow sports, local events, or cultural tours on the same day.
If rescheduling or offering alternative activities is not possible, a credit voucher will be issued for the unused portion of your activity. This voucher is valid for one year from the date of issue, is non-transferable, and must be surrendered upon redemption.
No refunds will be provided if you fail to follow the safety instructions given by your Always Winter Tours LLC instructor, including those related to the safety of the instructor, guide, other group members, or any individuals affected by your actions. Additionally, no refunds will be issued if your behaviour during the snow sport activity is deemed dangerous and results in the termination of your participation.
In the unfortunate event that your allocated instructor is ill or injured and unable to provide the booked service, Always Winter Tours LLC will endeavour to find a replacement instructor for your activity. If a replacement cannot be arranged, we will issue a full refund in the form of a credit note.
Powder Road Trips Policy
Please note that all scheduled Powder Road Trips only occur if there is a minimum of 3 confirmed participants. In the event that a trip does not reach the minimum requirement of 3 confirmed participants, the trip will be canceled, and a 100% refund will be issued to all registered clients.
Photography Policy
- Pre-shooting consultation: The parties agree to a pre-shoot consultation before the shoot in order to finalize, amongst other things, fees, times, and locations. This will usually take place via email.
- Shoot on ski resort:If the photoshoot is to take place at a ski resort, general terms & conditions apply.
- Completion schedule: Approximately 7 to 10 days after the date of the shoot, we will provide the client with the images. The Client will receive a copy of the images via an online link. This will contain selected photographs. We do not take responsibility for lost or damaged images once delivered to the Client.
- Marketing and Promotional Use of Photos: The client acknowledges and consents to Always Winter Tours LLC using the photographs taken during the shoot for marketing, promotional, and advertising purposes. This may include, but is not limited to, usage on our website, social media, and other promotional materials. If the client wishes to opt out of such use, they must provide explicit written notice to Always Winter Tours LLC prior to the photoshoot. In the absence of such notice, Always Winter Tours LLC reserves the right to use the photographs as described.
Cat Ski Policy
Deposits & Final Payment Prior to October 1st: A 50% deposit is required to secure your spot for all day tours and week-long bookings. This deposit is 90% refundable until October 1st. On October 1st, all deposits become non-refundable outside of the Always Winter Tours LLC cancellation policy (see below) and final balances are due. If final payment has not been received by November 1st, Always Winter Tours LLC reserves the right to cancel the booking and re-sell the space. There are no exceptions to this policy. All cancellations must be received in writing. After October 1st: Full payment is required at the time of booking. All payments made after this date are non-refundable outside of our cancellation policy (see below).
Cancellation Policy — Cancellations Initiated by Always Winter Tours LLC: In the rare event that Always Winter Tours LLC must cancel a day tour due to mechanical issues, adverse weather, or logistical complications that make the tour impossible to run, guests will receive a full refund. If a tour is already underway but cannot be completed due to unforeseen circumstances—such as sudden weather changes, equipment failure, or injury—partial refunds may be issued at the sole discretion of the Always Winter Tours LLC Operations team. Cancellations Initiated by the Customer: All customer cancellations are considered non-refundable, regardless of the reason. This includes, but is not limited to: personal scheduling conflicts, weather concerns, illness or injury, travel delays or inability to arrange transportation. We strongly encourage guests to purchase trip insurance to protect against these risks.
Important Notices / Assumption of Risk
By confirming your booking with Always Winter Tours LLC you agree to these terms and conditions. Participation in snow sports activities signifies your acceptance of these terms. If you do not agree with these terms, please do not register for or participate in any snow sports activities.
The snow sport activities you intend to participate in are conducted in hazardous environments and carry a risk of injury. These activities occur in locations far from medical facilities and are subject to environmental conditions. Please note that activities may be cancelled or modified without prior notice at Always Winter Tours LLC discretion.
Always Winter Tours LLC and its members are not liable for any physical, mental, or financial damages resulting from your negligence or the negligence of a third party. To the fullest extent permitted by applicable law, this limitation of liability also extends to claims arising from the ordinary negligence of Always Winter Tours LLC, its members, guides, or representatives in connection with your participation in snow sports activities; it does not extend to damages caused by gross negligence, recklessness, or intentional misconduct. If advised or deemed necessary by a member, you must seek immediate medical attention. You are also required to follow the instructions provided by Always Winter Tours LLC representatives or members at all times. Failure to comply may result in the termination of your participation in the activity. If a Always Winter Tours LLC representative or member deems your behavior during the activity to be dangerous or inappropriate, it may lead to immediate termination of your participation.
Please be aware that any photographs or videos taken of you during snow sports activities remain the property of Always Winter Tours LLC and may be used for promotional purposes unless otherwise requested.
All services provided by Always Winter Tours LLC are subject to availability and all rates are subject to change without prior notice. If lift passes are required, they are mandatory and are not included in the lesson or tour price.
Limitation of Liability
To the maximum extent permitted by applicable law, the total liability of Always Winter Tours LLC, its members, guides, and associated partners, arising out of or related to any booking, shall not exceed the total amount paid by the client for the relevant activity or trip.
Always Winter Tours LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost income, lost opportunity, or travel costs unrelated to the booked activity.
Responsibilities of the Lead Booker — Waiver
The person making the booking is responsible for informing all participants of the booking conditions and ensuring that the waiver form is completed before the start of the activity.
As a condition of participation in any snow sports activity organised by Always Winter Tours LLC all participants must complete a waiver form prior to the start of the activity. Failure to complete the waiver form may result in the cancellation of your booking without a refund. By signing the waiver, participants confirm their understanding and acceptance of the risks, as well as their agreement to the terms and conditions set forth by Always Winter Tours LLC.
Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Always Winter Tours LLC is legally established and registered, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms and Conditions or any booking shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, except where mandatory consumer protection laws applicable to the client's country of residence provide otherwise.
Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms and Conditions, together with the signed waiver form and any booking confirmation, constitute the entire agreement between the client and Always Winter Tours LLC regarding the booked activity, and supersede any prior agreements or representations, whether written or oral.
